Course content
Lectures: 1) Theory of law: law - division, legal branch, legal norm - structure, types, scope, legal order, sources of law - types, constitutional order, EU, internal regulations, legal force, legal relation - legal facts, elements, application of law - discretion, analogy, guarantees of legality, rule of law - welfare state, world legal systems. 2) Constitutional law: sources, Constitution of the Czech Republic - systematics, principles, state system, separation of powers, legislative process, fundamental rights and freedoms - sources, LZPS - systematics, principles, protection. 3) International law - division, sources, principles, relation to national law, subjects, population, protection of fundamental human rights - Universal Declaration of Human Rights, examples of conflict of laws and direct norms, jurisdiction and jurisdiction, position of foreigners in proceedings, legal aid, recognition and enforcement of foreign decisions. European Union - values, objectives, principles and powers, institutions and their powers, primary and secondary law, direct and indirect effect, supremacy of EU law, preliminary ruling procedure, single internal market, area of ??freedom, security and justice, EU Charter of Fundamental Rights . 4) Private law: legal facts. Persons: natural persons, legal entities, guardianship representation, guardianship council. 5) Absolute property rights: rights in rem, possession, ownership, co-ownership. Rights in rem to foreign objects: right of construction, easements, lien, right of retention. Inheritance law - waiver, refusal and waiver of inheritance, acquisition in case of death, inheritance classes, unforgettable heir, inheritance, liability of heirs for the debtor's debts, inheritance proceedings. Things: division, examples. 6) Relative property rights: incurrence of obligations, content of obligations, consumer contracts, common debts and receivables, changes in obligations, extinction of obligations, collateral and confirmation of debts. Liabilities from legal acts. Obligations for tort and other legal reasons - general assumptions of the obligation to compensate injury, preventive obligation, circumstances depicting the obligation to compensate injury, the manner and extent of compensation for harm, unjust enrichment. 7) Civil procedural law: sources, principles, types of civil proceedings, entities - jurisdiction and jurisdiction, court executor, notary, parties, lawyer, procedural acts - service, action, evidence - course, evidence, decision - forms, legal force and enforceability, costs of proceedings, course of proceedings at first instance, remedies, conditions of filing, enforcement and execution, mediation, arbitration. Seminars: 1) Examples of disposable and mandatory legal norms, transitional provisions of legal regulations, legal order, analysis of elements of legal relationship, guarantees of legality. 2) Analysis of the legislative process. 3) Citizenship, foreigners, refugees and asylum. 4) Analysis of transitional provisions of the NCC, analysis of binding legal norms, analysis of basic principles of private law. Analysis of cases of protection of personality, analysis of cases of limitation of legal capacity. 5) Analysis of ways of acquiring and protecting property, lien, acquisition in case of death, inheritance classes, heirs' liability for the testator's debts. 6) Analysis of the contract, defense against excessive contractual penalty, analysis of the purchase contract and complaints of defects, analysis of the gift contract, rental of the apartment, analysis of the loan agreement, analysis of the loan agreement, analysis of damage and non-property damage, analysis of special cases. 7) Analysis of the action - types, locus standi, particulars, form, effects, procedural conditions - litispendence, res iudicata, court fees, analysis of evidence, analysis of appeals, analysis of the Act on Special Procedures, preparation of a new Code of Civil Procedure.

Learning outcomes
The aim of the course Legal Theory and Practice 1 is to acquaint students with the basics of the theory of law and jurisprudence, civil law and constitutional law, international law and european union law. Students are allowed, among other things, through the case studies, to understand the operation of the above mentioned legal sector in the Czech and European or international system of law, together with the context of the social work and the social policy.
Students obtain knowledge in given course in accordance with requirements and course programme. Students will gain competence to apply knowledge from this course in practice.
Prerequisites
Students don't need special knowledge or visit other courses.

Assessment methods and criteria
Written exam, Oral presentation of self-study

Participation in seminars, active elaboration of all assigned tasks, the student prepares the assigned seminar paper and then passes the written exam. Verification of acquired knowledge and skills by examination. Exam: Written test Test from subject content with a success rate of at least 60%.
